Back Pay
Monthly Salary × Months Unemployed
Covers wages lost from the termination date to the date of settlement or trial judgment. Courts reduce this by any unemployment benefits received and earnings from interim employment.
Front Pay
Annual Salary Gap × 1–3 Years
Compensates for future lost earnings if you find a lower-paying job (or none yet). The salary gap is your old salary minus your new salary. Duration is typically 1–3 years until you reach comparable employment.
Emotional Distress
Mild: $5K–25K · Moderate: $25K–100K · Severe: $100K–$1M
Non-economic damages for mental anguish, anxiety, depression, loss of sleep, and damage to professional reputation. Varies widely based on documented severity, medical evidence, and jury sympathy.
Net Recovery
Total Damages × (1 − Attorney Fee %)
Your take-home after the contingency fee. Typical range: 33% pre-trial, 40% if case goes to trial. In states where attorney fees are awarded against the employer (CA, NJ, MN, etc.), your net recovery may be higher.
